To purchase a home in Ontario, you will require a lawyer, as only lawyers can certify title. However, technically, you do not require a lawyer to sell a house in Ontario. However, it would not be advisable to sell a house without the expertise of a lawyer in your corner. Feel free to call any real estate lawyer and ask them exactly what they will do for you as a home seller or home buyer.
Land Transfer Tax is imposed on the acquisition of an interest in land by registered conveyance or unregistered disposition. Every person obtaining interest inland is liable to Land Transfer Tax. Mortgage Brokers, Banks and other lenders will be more than happy to review your financial position and provide you with a price range in which you can comfortably shop for a home. They will also lock in an interest rate for you usually for 3 months, but sometimes as long as 6 months, ensuring that is rates rise, you are secure at the rate you locked in at. If rates drop, the lender will offer you the lower rate. Once you conditionally purchase your home, you will be required to provide details of the purchase to your lender so they can finalize their mortgage commitment to you, allowing you to remove that particular condition from your Purchase Agreement.
Real estate representatives must follow the strict guidelines set out in the provincial Real Estate and Business Brokers Act, 2002 (REBBA) which includes a Code of Ethics. The Real Estate Council of Ontario (RECO) focuses on consumer protection and administration of regulatory requirements for Ontario's real estate profession. They ensure that all real estate professionals are licensed and qualified to sell real estate in Ontario. They enforce the Code of Ethics and ensure members comply with REBBA. In addition, all real estate agents in Canada must adhere to the CREA's (Canadian Real Estate Association) Code of Ethics and Standards of Business Practice.
Occasionally a real estate company act as the agent for both the buyer and the seller. The buyer and seller must consent to this arrangement in their listing and buyer agency agreements. Under this "Dual Agency" arrangement, the Real Estate Brokerage must do what is best for both the buyer and the seller. Since the Brokerage's loyalty is divided between the buyer and the seller who have conflicting interests, it is absolutely essential that a dual agency relationship be established in a written agency agreement. This agreement specifically describes the rights and duties of everyone involved and any limitations to those rights and duties.
There are two types of agency relationships with respect to residential real estate, "Buyer Agency" and "Seller Agency". It used to be common for all parties involved to work for the seller, hence the term "Seller's Agent". Today, many Buyers sign a contract with an agent to find and purchase a home, creating a "Buyer Agency" relationship. If you are in the market to buy, it may be advisable to sign such a contract, ensuring you have a client relationship with your agent, and ensuring that your agent is working for you, not the seller. As such, your agent can make recommendations on what terms and price to offer, while negotiating a deal with your best interests in mind.
